Hesther Ng\/Reuters<\/p>\n\n\n\n<p>The government is currently trying to bypass basic parliamentary scrutiny by adding&nbsp;<a href=\"https:\/\/bills.parliament.uk\/publications\/44168\/documents\/1098\" target=\"_blank\" rel=\"noreferrer noopener\">18 pages of amendments<\/a>&nbsp;to a bill that has already made its way through the House of Commons. The last-minute changes, tabled in the House of Lords by an unelected peer, will not be scrutinised line by line in the usual manner. Instead, they will be rushed through without proper debate.&nbsp;<\/p>\n\n\n\n<p>Perhaps it is appropriate that this bill passes in such an egregious, anti-democratic way. The<a href=\"https:\/\/bills.parliament.uk\/bills\/2839\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;police, crime, sentencing and courts bill<\/a>&nbsp;has been described by various human rights groups as a serious threat to democracy. It was already stuffed full of legislation intended to criminalise protest and intimidate campaigners. It gave police the ability to shut down protests for causing \u201cserious annoyance\u201d or for being \u201ctoo noisy\u201d. It also&nbsp;<a href=\"https:\/\/www.liverpoolecho.co.uk\/news\/liverpool-news\/travellers-could-imprisoned-setting-up-20190702\" target=\"_blank\" rel=\"noreferrer noopener\">threatened Gypsy, Roma and Traveller communities<\/a>. Now the bill is back in parliament \u2013 and it\u2019s looking even worse.<\/p>\n\n\n\n<p>The government is trying to add&nbsp;<a href=\"https:\/\/bills.parliament.uk\/publications\/44168\/documents\/1098\" target=\"_blank\" rel=\"noreferrer noopener\">a whole suite of offences<\/a>&nbsp;that, if passed, will criminalise protest even further. Under these new proposals, activists could be imprisoned for obstructing roads and blocking printing presses. They could be banned from using the internet to organise protests. The amendments also include a proposal to allow police officers to stop and search people without grounds for suspicion \u2013 and with anyone trying to obstruct such a search liable to receive up to 51 weeks in prison.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>Not content with the dangerous and discriminatory&nbsp;<a href=\"https:\/\/twitter.com\/hashtag\/PolicingBill?src=hash&amp;ref_src=twsrc%5Etfw\">#PolicingBill<\/a>&nbsp;that sparked months of&nbsp;<a href=\"https:\/\/twitter.com\/hashtag\/KillTheBill?src=hash&amp;ref_src=twsrc%5Etfw\">#KillTheBill<\/a>&nbsp;demonstrations, the Government\u2019s latest additions somehow make the Bill even worse.<\/p><p>We break them down below<br>\u2b07\ufe0f\u2b07\ufe0f\u2b07\ufe0f<\/p><p>\u2014 Liberty (@libertyhq)&nbsp;<a href=\"https:\/\/twitter.com\/libertyhq\/status\/1466012311286652933?ref_src=twsrc%5Etfw\">December 1, 2021<\/a><\/p><\/blockquote>\n\n\n\n<p>One of the most controversial proposals is the introduction of&nbsp;<a href=\"https:\/\/bills.parliament.uk\/publications\/44168\/documents\/1098\" target=\"_blank\" rel=\"noreferrer noopener\">\u2018serious disruption prevention orders\u2019<\/a>, which can be imposed with or without a conviction. These orders can be used on anyone who has been to two or more protests in the last five years. Whether you marched over racism, climate change or Brexit, everyone is at risk \u2013 providing, of course, that the protest you attended was \u201clikely to cause serious disruption\u201d, as all effective protests are. If you meet the criteria, the police will be able to prevent you from being with certain people, going to certain places, and carrying certain items. Want to tell your friends about a protest on Facebook? Forget it.<\/p>\n\n\n\n<p>Under the new bill, the home secretary will advise the police on how and when to implement these orders. They will also be able to define what \u201cserious disruption\u201d means with regard to all of these offences, handing sweeping powers to the government of the day. The current home secretary Priti Patel has&nbsp;<a href=\"https:\/\/www.theguardian.com\/world\/2021\/oct\/12\/priti-patel-borders-bill-breaches-law-human-rights\" target=\"_blank\" rel=\"noreferrer noopener\">repeatedly tried to break international and domestic law<\/a>, and is now introducing legislation to&nbsp;<a href=\"https:\/\/www.newstatesman.com\/politics\/2021\/12\/exclusive-british-citizenship-of-six-million-people-could-be-jeopardised-by-home-office-plans\" target=\"_blank\" rel=\"noreferrer noopener\">strip naturalised UK citizens of their citizenship<\/a>. Should she really have the power to ban people from attending protests? Should anyone have such power?<\/p>\n\n\n\n<p>Another proposal is&nbsp;<a href=\"https:\/\/www.gov.uk\/government\/news\/government-cracking-down-on-highly-disruptive-protest-tactics\" target=\"_blank\" rel=\"noreferrer noopener\">to criminalise \u2018locking on\u2019<\/a>, a tactic that has been used by peaceful protesters for centuries. This proposal will make it an offence to \u201cattach\u201d oneself to another person, an object, or to attach an object to another object during a protest. Does that make sense? It better do, because it will also carry a maximum sentence of 51 weeks in prison.<\/p>\n\n\n\n<p>Home Office minister&nbsp;<a href=\"https:\/\/www.gbnews.uk\/news\/crackdown-needed-against-reckless-and-selfish-eco-activists-says-minister\/164385\" target=\"_blank\" rel=\"noreferrer noopener\">Baroness Williams of Trafford has said<\/a>&nbsp;these measures are necessary in order to \u201cprotect the public from unacceptable levels of disruption\u201d, pointing the finger at \u201creckless and selfish\u201d activist groups like Extinction Rebellion and Insulate Britain. Her boss, Priti Patel, has also described protesters who chain themselves to buildings, like the suffragettes did in the early twentieth century, as&nbsp;<a href=\"https:\/\/www.gov.uk\/government\/news\/government-cracking-down-on-highly-disruptive-protest-tactics\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cselfish\u201d<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.theguardian.com\/environment\/2020\/sep\/08\/extinction-rebellion-criminals-threaten-uks-way-of-life-says-priti-patel\" target=\"_blank\" rel=\"noreferrer noopener\">\u201ccriminal\u201d<\/a>.<\/p>\n\n\n\n<p>The final amendment to the bill, rushed through at the very last moment, makes protesting outside train stations, airports or oil refineries an offence. The government came up with this idea last year, after&nbsp;<a href=\"https:\/\/www.societyofeditors.org\/soe_news\/printing-presses-could-be-designated-critical-infrastructure-by-government\/\" target=\"_blank\" rel=\"noreferrer noopener\">climate activists blocked two printing presses owned by Rupert Murdoch<\/a>&nbsp;\u2013 an act of peaceful protest described by Patel as an \u201cattack on capitalism\u201d. This new offence criminalises any protester that&nbsp;\u201cinterferes with the use or operation of any key national infrastructure\u201d, and carries a maximum sentence of one year in prison. The bill, which is over 300 pages long, was voted through the House of Commons just six days after publication. There has not been time to properly consider or scrutinise it. The wording is vague and ill-defined. Many of the offences effectively include all acts of protest.<\/p>\n\n\n\n<p>There is a possibility, of course, that these amendments won\u2019t pass through the House of Lords. Baroness Williams was previously&nbsp;<a href=\"https:\/\/www.mirror.co.uk\/news\/politics\/fury-tories-introduce-outrageous-new-25548047\" target=\"_blank\" rel=\"noreferrer noopener\">forced to withdraw the amendments<\/a>&nbsp;after outrage from her colleagues \u2013 but she has now tabled them again. Williams, notably, is hardly a great champion of democracy: she ran for election and was rejected by the electorate twice, before being given a life peerage by David Cameron in 2013.<\/p>\n\n\n\n<p>When the bill was read in the House of Commons in the summer, the MP for Swansea West Geraint Davies described it as&nbsp;<a href=\"https:\/\/hansard.parliament.uk\/commons\/2021-07-05\/debates\/24D0FCFD-C6AB-4854-A9A0-2629FA4AEE20\/PoliceCrimeSentencingAndCourtsBill\" target=\"_blank\" rel=\"noreferrer noopener\">\u201can act of political treason\u201d<\/a>. He argued: \u201cPeople in this country should not rest until it is overturned and our rights reinstated, so that democracy can live, breathe and thrive again\u201d. The bill is now even worse \u2013 and he is still absolutely right.<\/p>\n\n\n\n<p>Who cares about democracy, anyway? That\u2019s the question we all need to ask ourselves. The government certainly doesn\u2019t. The Labour party is hardly much better. If opposition is going to come from anywhere, it will come from the people. Now, the most realistic way to defeat this draconian piece of legislation is to make it unworkable. That means mass mobilisations, rolling demonstrations and direct action. The power of protest is going to have to defend the right to protest.
